Terms of the Agreement:
The Guest(s) shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner.
The Guest(s) shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Owner as being immediately habitable by the next tenants.
Guest(s) shall pay for maintenance and repairs should the premises be left in a lesser condition.
Guest(s) agrees to remove shoes when entering the house. Shoes are not to be worn inside the house.
Guest(s) agrees to remove sand from feet before entering the house. A hose is provided for washing feet outside prior to entry and is located at the side of the house.
Guest(s) agrees to not move furniture.
Guest(s) agree to pay for any damage at costs provided by receipt for unauthorized moving of furniture resulting in damage.
Guest(s) shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the bins in the garbage bin during their stay for pickup.
Monday is garbage day and is picked up early morning. Trash collectors retrieve trash bin from the house, so Guest(s) need not move trash bins.
Guest(s) is cautioned not to leave trash outside for long periods of time because it attracts animals.
No animals or pets of any kind will be brought onto the premises. Guest(s) agree if violating this clause, Guest(s) will be responsible for the cost of deep cleaning the full house and for any lost revenue if the house is not habitable, without pet hair, dander, or stains, before the arrival of the next Guest(s). In addition, Guest(s) agree to pay a fine of not less than $500 per night if violating this clause.
Guests shall not sublet the property. The Guest(s) shall have no more than 6 persons in total reside in the home. Guest(s) agree that violation of this policy shall result in immediate eviction without compensation. Tents are not allowed to be used on the property.
Guest(s) shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners.
There shall be no smoking inside the premises. Guest(s) agree to pay a fine of not less than $500 if violating this clause, plus any of the fines mandated by the City of Manzanita, the County of Tillamook, or the State of Oregon.
The Guest(s) shall hereby indemnify and hold harmless the Owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Owner may maintain on the property does not cover the personal property of Guest(s), and that Guest(s) should purchase their own insurance for Guest(s) if such coverage is desired. Guest(s) agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Owner enforcing this agreement. Further, Guest(s) agree the local courts of Tillamook County will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with this Agreement. Further Owner and Guest(s) agree to submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Tillamook County or the nearest applicable local court.
Guest(s) expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Guest(s) do not intend to make the property a residence, household, or event venue.
It is the Guest(s) responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the ocean. Guest(s) agree to have a responsible adult supervising minors at all times.
Guest(s) is hereby notified that the beach can be dangerous and tenant accepts fully the risks involved. The beach and ocean areas are a risk 100% the responsibility of each Guest(s).
No firearms shall be allowed on the premises according to State and local laws. Guest(s) agrees that Fireworks and other hazardous materials shall not be used in or around the property.
Guest(s) shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits. Additionally, the property will only be used by Guest(s) for vacation purposes only, unless written permission is obtained by Owner for other activities.
Guest(s) is advised that the property contains a gas grill, and other gas powered items and will seek help from management if the proper operation of such items is not fully understood. Further, Guest(s) assumes any and all liability for use of gas grill or other gas powered items.
The property has (1) fire extinguishers located in the master bedroom closet. The fire extinguisher was fully charged at last inspection. It is the duty of the Guest(s) to inform Owner immediately should the fire extinguisher become less than fully charged. Guest(s) agrees to use the fire extinguisher only for true emergencies.
The property has fire alarms installed and they are believed to function properly at the time of rental. Guest(s) will notify management without delay if a fire alarm “chirps” or has a low battery condition.
Guest(s) is advised that there is a carbon monoxide detector on the property.
Guest(s) shall see to their own security while in the property by locking doors, windows, garage doors, security the property and the property of Guest(s) when it’s prudent to do so. Owner is not responsible for items of Guest(s) that are lost, stolen, or items left on the premises after departure. As much as is possible and reasonable, valuable items left behind by tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 6 months they shall become the property of the Owner. The Owner shall not be help liable for condition of said items.
High speed wireless internet and cable TV is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
Further, Guest(s) agree the internet of the property will not be used for any and all illegal activities, whether under local, state or federal laws. Guest(s) assume any and all responsibility for internet usage and internet activities during the use of Guest(s) stay, including fines, fees, or legal proceedings.
Guests acknowledge no parties (including but not limited to more than 10 guests on the premises), events or commercial activities shall take place on the premises without prior permission. .
